General Terms and Conditions of Sale
These General Terms and Conditions of Sale (the “Terms”) govern all purchases made via the websites Jacquemond.com and Jacquemond-France.com (the “Website”), operated by DBJ Prod Sarl, a company registered with the Lyon Trade and Companies Register under number 489 341 727, with its registered office located at Bâtiment Jacquemond, 69530 Brignais, France (hereinafter referred to as the “Maison” or the “Seller”).
Article 1 – Purpose
These Terms define the conditions under which the Maison offers for sale, and the Client acquires, exclusive high-end customization components, including bespoke creations, limited editions, and products distinguished by their exceptional aesthetic, technical, and artisanal value (the “Products”).
Article 2 – Scope
These Terms apply to any order placed on the Website by any individual or legal entity (the “Client”), whether acting in a personal or professional capacity.
Any purchase made on the Website constitutes full, unconditional, and irrevocable acceptance of these Terms, which prevail over any other document or communication.
Article 3 – Products
Each Product is presented with the utmost care and precision. Due to their artisanal, bespoke, or limited-edition nature, slight variations may occur, particularly in tone, texture, finish, or materials. Such variations are inherent to the exclusivity and craftsmanship of the Products and do not affect their conformity.
All visuals, photographs, renderings, and illustrations presented on the Website are for illustrative purposes only and are non-contractual.
Article 4 – Orders
Orders are placed directly on the Website in accordance with the process in effect. An order becomes final only upon confirmation of payment.
The Maison reserves the right to refuse or cancel any order in the event of an existing dispute with the Client, non-payment of a previous order, inaccurate or incomplete information, or any suspicion of fraudulent activity.
Article 5 – Prices
Prices are stated in the selected currency and exclude delivery charges.
The Maison reserves the right to amend its prices at any time. Products are invoiced at the rates in effect at the time the order is confirmed.
For deliveries outside the European Union, additional charges may apply and remain entirely at the Client’s expense. These may include, without limitation, banking fees (transfer or currency exchange fees) as well as import duties, taxes, or customs charges imposed by local authorities.
Article 6 – Payment
Full payment is required at the time the order is placed.
Accepted methods of payment include: credit card (via PayPal), PayPal, and bank transfer.
Article 7 – Delivery
Products are delivered to the address specified by the Client at the time of order.
Delivery times are provided for indicative purposes only, particularly for bespoke or made-to-order Products. Any delay shall not give rise to liability on the part of the Maison nor entitle the Client to cancel the order, except as required by mandatory legal provisions.
Risk of loss or damage to the Products transfers to the Client upon receipt of the Products.
Article 8 – Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to Products that are bespoke, customized, or produced according to the Client’s specifications.
Article 9 – Returns and Refunds
Returns are accepted solely for Products eligible for the right of withdrawal, provided they are returned in pristine condition, unused, and in their original packaging.
Return shipping costs are borne by the Client, unless the return results from an error attributable to the Maison.
Refunds shall be processed within a minimum period of fourteen (14) days following receipt and inspection of the returned Products.
Article 10 – Warranties
The Products benefit from statutory warranties of conformity and protection against hidden defects, in accordance with applicable provisions of the French Consumer Code and the French Civil Code.
Any warranty is excluded in the event of improper use, normal wear and tear, negligence, or any alteration or modification of the Product by the Client.
Article 11 – Liability
The Maison shall not be liable for any indirect, immaterial, or consequential damages arising from the use or enjoyment of the Products.
In all circumstances, the Maison’s liability shall be strictly limited to the total amount paid for the order concerned.
Article 12 – Intellectual Property
All elements of the Website, including but not limited to the Products, designs, models, texts, images, logos, and trademarks, are protected by intellectual property rights and remain the exclusive property of the Maison.
Any reproduction, representation, distribution, or exploitation, in whole or in part, without prior written authorization from the Maison is strictly prohibited.
Article 13 – Personal Data
Personal data collected via the Website is processed in strict compliance with applicable data protection regulations, including the General Data Protection Regulation (GDPR).

Article 14 – Governing Law and Dispute Resolution
These Terms are governed by French law.
In the event of a dispute, the parties agree to seek an amicable resolution in good faith prior to initiating any legal proceedings. Failing such resolution, the competent courts shall be those within the jurisdiction of the Maison’s registered office, subject to mandatory legal provisions.
Article 15 – Acceptance of the Terms
The Client acknowledges having read, understood, and accepted these Terms in their entirety, without reservation, prior to placing any order on the Website.
