These General Terms and Conditions of Sale (the \u201cTerms\u201d) govern all purchases made via the websites Jacquemond.com and Jacquemond-France.com (the \u201cWebsite\u201d), operated by DBJ Prod Sarl, a company registered with the Lyon Trade and Companies Register under number 489 341 727, with its registered office located at B\u00e2timent Jacquemond, 69530 Brignais, France (hereinafter referred to as the \u201cMaison\u201d or the \u201cSeller\u201d).<\/em><\/p>

Article 1 \u2013 Purpose<\/strong><\/h3>

These Terms define the conditions under which the Maison offers for sale, and the Client acquires, exclusive high-end customization components, including bespoke creations, limited editions, and products distinguished by their exceptional aesthetic, technical, and artisanal value (the \u201cProducts\u201d).<\/p>

Article 2 \u2013 Scope<\/strong><\/h3>

These Terms apply to any order placed on the Website by any individual or legal entity (the \u201cClient\u201d), whether acting in a personal or professional capacity.<\/p>

Any purchase made on the Website constitutes full, unconditional, and irrevocable acceptance of these Terms, which prevail over any other document or communication.<\/p>

Article 3 \u2013 Products<\/strong><\/h3>

Each Product is presented with the utmost care and precision. Due to their artisanal, bespoke, or limited-edition nature, slight variations may occur, particularly in tone, texture, finish, or materials. Such variations are inherent to the exclusivity and craftsmanship of the Products and do not affect their conformity.<\/p>

All visuals, photographs, renderings, and illustrations presented on the Website are for illustrative purposes only and are non-contractual.<\/p>

Article 4 \u2013 Orders<\/strong><\/h3>

Orders are placed directly on the Website in accordance with the process in effect. An order becomes final only upon confirmation of payment.<\/p>

The Maison reserves the right to refuse or cancel any order in the event of an existing dispute with the Client, non-payment of a previous order, inaccurate or incomplete information, or any suspicion of fraudulent activity.<\/p>

Article 5 \u2013 Prices<\/strong><\/h3>

Prices are stated in the selected currency and exclude delivery charges.<\/p>

The Maison reserves the right to amend its prices at any time. Products are invoiced at the rates in effect at the time the order is confirmed.<\/p>

For deliveries outside the European Union, additional charges may apply and remain entirely at the Client\u2019s expense. These may include, without limitation, banking fees (transfer or currency exchange fees) as well as import duties, taxes, or customs charges imposed by local authorities.<\/p>

Article 6 \u2013 Payment<\/strong><\/h3>

Full payment is required at the time the order is placed.<\/p>

Accepted methods of payment include: credit card (via PayPal), PayPal, and bank transfer.<\/p>

Article 7 \u2013 Delivery<\/strong><\/h3>

Products are delivered to the address specified by the Client at the time of order.<\/p>

Delivery times are provided for indicative purposes only, particularly for bespoke or made-to-order Products. Any delay shall not give rise to liability on the part of the Maison nor entitle the Client to cancel the order, except as required by mandatory legal provisions.<\/p>

Risk of loss or damage to the Products transfers to the Client upon receipt of the Products.<\/p>

Shipping by Chronopost\/UPS. Jacquemond is not responsible for delivery delays or breakage (the package is insured; if it shows any damage, even after opening the packaging, you will need to take photos to activate the insurance, which Jacquemond will manage).<\/p>

Article 8 \u2013 Right of Withdrawal<\/strong><\/h3>

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to Products that are bespoke, customized, or produced according to the Client\u2019s specifications.<\/p>

Article 9 \u2013 Returns and Refunds<\/strong><\/h3>

Returns are accepted solely for Products eligible for the right of withdrawal, provided they are returned in pristine condition, unused, and in their original packaging.<\/p>

Return shipping costs are borne by the Client, unless the return results from an error attributable to the Maison.<\/p>

Refunds shall be processed within a minimum period of fourteen (14) days following receipt and inspection of the returned Products.<\/p>

Article 10 \u2013 Warranties<\/strong><\/h3>

The Products benefit from statutory warranties of conformity and protection against hidden defects, in accordance with applicable provisions of the French Consumer Code and the French Civil Code.<\/p>

Any warranty is excluded in the event of improper use, normal wear and tear, negligence, or any alteration or modification of the Product by the Client.<\/p>

Article 11 \u2013 Liability<\/strong><\/h3>

The Maison shall not be liable for any indirect, immaterial, or consequential damages arising from the use or enjoyment of the Products.<\/p>

In all circumstances, the Maison\u2019s liability shall be strictly limited to the total amount paid for the order concerned.<\/p>

Article 12 \u2013 Intellectual Property<\/strong><\/h3>

All elements of the Website, including but not limited to the Products, designs, models, texts, images, logos, and trademarks, are protected by intellectual property rights and remain the exclusive property of the Maison.<\/p>

Any reproduction, representation, distribution, or exploitation, in whole or in part, without prior written authorization from the Maison is strictly prohibited.<\/p>

Article 13 \u2013 Personal Data<\/strong><\/h3>

Personal data collected via the Website is processed in strict compliance with applicable data protection regulations, including the General Data Protection Regulation (GDPR).<\/p>

Further details regarding the processing of personal data are set out in the Website\u2019s Privacy Policy.<\/p>

Article 14 \u2013 Governing Law and Dispute Resolution<\/strong><\/h3>

These Terms are governed by French law.<\/p>

In the event of a dispute, the parties agree to seek an amicable resolution in good faith prior to initiating any legal proceedings. Failing such resolution, the competent courts shall be those within the jurisdiction of the Maison\u2019s registered office, subject to mandatory legal provisions.<\/p>

Article 15 \u2013 Acceptance of the Terms<\/strong><\/h3>
